Discontinuing The Use Of Ammonium Nitrate
In Our Company’s Instant Cold Pack Products

To enhance public security, the Government of Canada has enacted the Restricted Components Regulations (“RCR”) which govern the sale of ammonium nitrate having a nitrogen concentration between 28% and 34% (“AN”). These regulations are consistent with other regulatory measures pertaining to ammonium nitrate which have been adopted, or are being considered, in the United States, the European Union, the United Kingdom, Australia, and other countries.

The RCR attempt to prevent AN from being acquired for terrorist or criminal purposes as AN can, under certain circumstances, be used as an explosive. The RCR impose various security, inventory control, record keeping, and customer identification requirements upon each seller of AN.

AN has been the active ingredient in our company’s Instant Cold Packs (“Cold Products”) for some time. While the amount of AN in our Cold Products is small, we have decided to discontinue the use of AN in our Cold Products and use calcium ammonium nitrate (“CAN”) in place of AN.

The use of CAN will continue to allow our company to provide Cold Products that meet established performance requirements for Instant Cold Packs. However, at the same time, CAN is not subject to the public security concerns associated with AN. By making this change, we can contribute to the security of the general public. We can also relieve our customers of the need to comply with the increasingly global regulatory requirements associated with the purchase and sale of AN.

These benefits have led our company to quickly implement our change to CAN. As of November 5, 2010, our company will only use CAN in its Cold Products although Cold Products containing AN manufactured by our company prior to this date will still be in the supply chain for a period of time. Rapid Aid Cold packs are filled with Calcium Ammonium Nitrate. This will be indicated by our Lot number.

The "RCR" will be contacting all companies that sell Instant Cold Packs in Canada that contain Ammonium Nitrate. Please note that should your company sell Ammonium Nitrate Instant Cold Packs from other suppliers that are a nitrogen concentration of between 28 to 34 percent, then your company will need to register as a seller of Ammonium Nitrate. For your information, we have attached a link to the RCR which require sellers of AN in Canada to register with the Canadian Government and to implement various internal security and customer identification requirements: http://laws.justice.gc.ca/eng/SOR-2008-47/page-1.html. We recommend that you update your sales literature and web site information pertaining to our cold products and also recommend to your customers that they do the same if they are resellers of our cold products to avoid this registration process when contacted by the "RCR".
